Should you take field sobriety tests or a portable breath test?
The San Francisco DUI attorneys at Okabe & Haushalter have dealt with thousands of criminal cases, and understand driving under the influence statutes. Because of their knowledge in this arena, they are often asked “Should I take the field sobriety tests?” This firm recommends that you do not take the field sobriety tests if you are pulled over under suspicion of drunk driving. What you should not refuse is a chemical test (breath, blood, and in some cases urine tests). Failure to take a chemical test after a lawful DUI arrest can result in automatic license suspension for a period of one year. To put it simply, yes you can refuse the field sobriety tests (walk and turn, one-leg stand, etc.) but you should not refuse the blood alcohol content (BAC) tests.
