The Type of Drug Can Affect the Penalties

Drug crime is an umbrella term used to refer to any criminal offense involving an illegal drug or controlled substance. There is, however, a lot of variation in the crimes that fall under this umbrella. For example, a drug crime could mean the possession of an ounce of marijuana or trafficking pounds of cocaine. This is where differences in penalties often originate: the type of drug involved. While other factors certainly play a part in the sentencing of drug-related crimes (such as the amount of the drug, the purpose of its possession, and the defendant’s prior criminal history), the type of drug plays an enormous role in the penalties a defendant may face.

About Drug Schedules

In the state of Nevada, drugs are divided into separate categories that are known as “schedules.”

The five separate categories of drugs are explained below:

  • Schedule I: These have the highest potential for abuse / addiction with no accepted medical use. Examples include heroin, LSD, peyote, Ecstasy, and marijuana.
  • Schedule II: Drugs in this category have a high abuse potential, but they have a currently accepted medical use in treatment with severe restrictions. Examples include cocaine, OxyContin, met, Ritalin, and Adderall.
  • Schedule III: These drugs have a moderate potential for abuse less than Schedule I and II and have a currently accepted medical use in treatment. An example is Vicodin.
  • Schedule IV: There is a low abuse potential with these drugs and a currently accepted medical use in treatment. Examples include Xanax, Valium, and Ambien.
  • Schedule V: These drugs have an even lower potential for abuse when compared to Schedule IV and an accepted medical use in treatment. An example is Robitussin AC.
